"Pay-Once Plan" refers to a one-time payment plan that provides users with credits for a single purchase.
"Content" refers to any icons, logos, illustrations, or other design assets generated by the user through the platform.
"Third-Party Payment Processor" refers to external services, such as Stripe, used to process payments.
"Generative AI" refers to the artificial intelligence technology used by iconkit.dev to automatically generate design assets based on user input.

3. Eligibility

The platform is not intended for use by individuals under the age of 13. If you are using the platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these terms.

4. Plans and Credits

Subscription Plans: Users can subscribe to monthly plans that provide a set number of credits each month. Subscription fees are billed automatically on a recurring basis.
Pay-Once Plans: Users can purchase credits through a one-time payment. These credits are non-recurring and do not renew automatically.
Credit Expiration: Credits are valid for 30 days from the date of purchase or allocation. Unused credits will expire after this period.
No Refunds: All purchases, including subscription fees and pay-once credits, are non-refundable under any circumstances whatsoever, including but not limited to unused credits, account termination, or service interruptions. By making a purchase, you acknowledge and agree that you are not entitled to any refunds, chargebacks, or compensation for unused credits or any other reason.
Payment Processing: Payments are processed through third-party payment processors, such as Stripe. By making a purchase, you agree to comply with the terms and conditions of the payment processor. We are not responsible for any errors, delays, or issues arising from the payment process, including but not limited to failed transactions, chargebacks, or unauthorized charges.
Taxes: You are responsible for any applicable taxes, including VAT, sales tax, or other government-imposed fees, associated with your purchase of credits or subscription plans.

5. User-Generated Content

Ownership: Users retain ownership of the icons and design assets they generate using the platform. However, by using the platform, you grant iconkit.dev a non-exclusive, worldwide, royalty-free license to use, display, and distribute the generated content for the purpose of providing the service.
Commercial Use: Users are granted a non-exclusive, worldwide, royalty-free license to use the generated assets for personal and commercial purposes.
Third-Party Sharing: User-generated icons and assets are not shared with third parties unless explicitly authorized by the user or required by law.
Prohibited Content: Users may not generate content that is illegal, harmful, or violates the intellectual property rights of others. iconkit.dev reserves the right to remove any content that violates these terms.

6. Generative AI Disclaimer

AI-Generated Content: The design assets generated by iconkit.dev are created using generative AI technology. While we strive to provide high-quality results, AI is not perfect and may produce content that is inaccurate, incomplete, or not aligned with your expectations.
No Liability for AI Output: By using the platform, you acknowledge and agree that iconkit.dev and Raiden AI LLC are not liable for any errors, inaccuracies, or issues arising from the AI-generated content. You are solely responsible for reviewing and verifying the suitability of the generated assets for your intended use.
No Guarantee of Perfection: We do not guarantee that the AI-generated content will meet your specific requirements or be free from defects. The use of AI-generated content is at your own risk, and we disclaim any liability for any damages or losses resulting from the use of such content.

7. User Responsibilities

Account Security: Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account. You must notify us immediately if you suspect any unauthorized use of your account.
Prohibited Activities: Users may not use the platform for illegal activities, to infringe on the intellectual property rights of others, or to distribute harmful or malicious content. Any violation of these terms may result in the suspension or termination of your account.

Governing Law: These terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles.
Dispute Resolution: Any disputes arising from these terms or your use of the platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Sheridan, Wyoming, and the decision of the arbitrator shall be final and binding.
